RocSite Real Estate Buyer Agency Agreement
Introduction:
This Buyer Agency Agreement ("Agreement") is entered into between RocSite Real Estate ("Firm") and the undersigned buyer(s) ("Buyer"). By signing this Agreement, the Buyer agrees to retain RocSite Real Estate as their exclusive buyer’s agent under the terms and conditions outlined below.
1. Agency Relationship
RocSite Real Estate agrees to act as the exclusive agent for the Buyer in the acquisition of real property, including any purchase, option, or exchange on terms and conditions acceptable to the Buyer. The Firm is committed to:
- Promoting the interests of the Buyer.
- Performing the terms of this Agreement diligently.
- Seeking property at a price and terms acceptable to the Buyer.
- Presenting all written offers and counteroffers in a timely manner.
- Disclosing all material facts related to the property or transaction.
- Accounting for all funds and property received on behalf of the Buyer.
2. Term of Agreement
This Agreement shall commence on the date signed by the Buyer and will terminate at 11:59 PM, three (3) months from the Effective Date, unless extended by mutual written consent.
3. Duties of the Buyer
The Buyer agrees to:
- Work exclusively with RocSite Real Estate during the term of this Agreement.
- Provide accurate and complete information to assist the Firm in finding suitable properties.
- Immediately inform RocSite Real Estate of any properties in which they have an interest.
- Conduct all negotiations and communications related to the purchase of real property through RocSite Real Estate.
4. Initial Consultation/Showing
The Buyer is entitled to one (1) complimentary showing with RocSite Real Estate. If, after this initial showing, the Buyer chooses not to continue working with RocSite Real Estate, no charges will be incurred.
5. Compensation
Commission: If the Buyer continues to work with RocSite Real Estate beyond the initial showing, the Buyer agrees to pay a commission equal to 3% of the purchase price of any property acquired during the term of this Agreement.
Hourly Rate: Alternatively, if the Buyer opts for an hourly arrangement, the Buyer agrees to pay $75 per hour for all billable work performed by RocSite Real Estate, including but not limited to property showings, travel, and other related services. Additionally, the Buyer will reimburse the Firm for any reasonable expenses incurred in connection with these services.
No Purchase within Three Months: If no property is purchased within the three-month term, and the Buyer has not opted for the hourly rate, the Buyer agrees to be billed at the rate of $75 per hour for all billable work, travel, and other related expenses incurred during the term of this Agreement.
No Double Payment: If RocSite Real Estate receives compensation from the seller or listing firm, such compensation shall be credited towards the amounts due under this Agreement, unless prohibited by law.
6. No Obligation After Initial Showing
If the Buyer chooses not to engage RocSite Real Estate’s services beyond the initial complimentary showing, this Agreement will terminate with no further obligation on either party.
7. Termination of Agreement
This Agreement may be terminated by mutual written consent of both the Buyer and RocSite Real Estate. If the Buyer wishes to terminate this Agreement after the initial complimentary showing and prior to the expiration of the three-month term, the Buyer must provide written notice to RocSite Real Estate.
8. Governing Law
This Agreement is governed by the laws of the State of North Carolina. Any legal proceedings arising from this Agreement shall be filed in the appropriate courts within the State of North Carolina.
9. Acknowledgment and Acceptance
By signing below, the Buyer acknowledges that they have read and understand the terms of this Agreement. The Buyer agrees to be bound by these terms and acknowledges that this Agreement is legally binding.
